Goodbye to America
I've literally become homeless. My new home is now hoder.com and I'm not joking.
You might have seen a small change in my little biography on the right hand side. I had said that I was in New York. But I'm now out of the States and can't go back at least for six months.
It was actually my blog that got me into trouble after a month of staying in my friend's flat in lower-Manhattan, NYC. It's a sad but real story.
The last time I decided to go back to Toronto for a night, I took a bus. A huge mistake, now I know. When I wanted to come back to NYC, I was obviously stopped and interviewed by US Customs and Border Security people at the Buffalo border (Peace Bridge), like everyone else on the bus.
But when they realized I was going to the States to speak at a blog-related conference (ConvergeSouth) they started to google my name right in front of me. Two officers, actually.
They carefully scanned the results and found this English blog. One of them, a very sharp guy in fact, started to read every single post on my blog. And it didn't take long until he shocked me: "So you live in New York, right? That's what you've written in your on blog."
I had no idea googling people at the border had become a routine. So instead of defending me with some simple legal arguments about my rights as a Canadian citizen and what I meant by that sentence, I kind of felt desperate and said I did that because I was there for some back-to-back events and conferences and I thought saying you are in New York is sexier than Toronto -- which actually is, don't you think?
He was ecstatic. My blog made his day, or in this case, his night. He kept reading my posts and asking questions about a lot of them: Why did I go to Iran, what are my feelings about Bush administration, why I separated from my wife, what did I think about Iranian politics, etc.
The guy wanted to get me into deep trouble so ultimately I would never go back to his lovely country, apparently. So he started to look for evidence that I'd also worked in the States and were paid by American. Until he found, in my archive, a post I'd written before leaving for Iran, to ask for the blogging community's attention and support, especially if something happened to me in Iran and about how they could help in that case.
Sarcastically, I'd reminded everyone not to be surprised if, while in detention in Iran, I confessed about some absurd wrongdoings form the Islamic regime's point of view, such as: getting money from the CIA, trafficking illegal drugs, dating Natalie Portman and Kiera Knightly, etc.
"So you are getting money for the Bush administration," the officer asked. I was speechless. "Come on! This is a joke. Read the whole thing and put it in a context." Fortunately the guy was a smart man and realized the sarcasm. However he said these things are not quite appropriate to be on your blog when you are at the border. He was right.
But later, when he had still doubt about letting me in or not, he found the latest issue of Newsweek in my small suitcase on which I had my NYC address. There were many others with my Toronto address, but that single was enough to convince him about my situation. I didn't challenge him again. God, I wish I were a lawyer. I could've said this magazine is important for me and I didn't want to miss a single issue of it by being away from home.
So then he took me to another room and spent about two hours writing a report and registering and documenting my refusal of entry.
Now the result is that, apparently, I can't visit the States at least for six months and even after that I should prove I'm established enough in Canada. I also have to explain why I failed to register my departure when the bus driver didn't stop while crossing the US border to Canada.
Now I feel there is no place in New York City, the most cosmopolitan city in the world. But it's the end of the world. Even it might be better for me to spend more time in Europe and learn new languages.
It's sad to see America is not the land of the free anymore.
P.S: Some of the readers think I had broken law by staying in the US. But as a Canadian citizen I'm allowed to visit and stay in the US for up to six month. It was only one month I was in New York City and I was staying with a friend. How that could be breaking the law?

I find it amazing that the Border Patrol has access to computers. That is so futuristic! The fact that they would Google you is even more amazing. From most of the advice you are getting here I am sure you have learned to keep it simple when crossing a border. I am one that thinks it is crazy that there is so much friction at our border with Canada. I get slowed down by it all the time. Post (infamous date) there was the handcuff incident.

But women are beautiful, weather too, and no one will define you as "mexican male", "AFro american" or whatever those racist have in mind.
USA is now like Germany in the second war, and Bush, a little like Hitler, but more stupid, if it is possible.

If it makes you feel any better, I got the fifth degree going in the other direction, to Montreal (I am a US citizen.) I got talkative with the border guard and almost got into a lot of trouble (they decided that I was secretly trying to emigrate to Canada.)
MAJOR LESSON: keep your mouth shut. Say only what you need to say to get through. Border guards like to keep you talking so that you can trip yourself up, and anything can set them off.
How on Earth did they find out you were going to a blogging conference? You should have just said "conference" and if they wanted more said "computer technology".
Trust me, I know: don't give them anything more than they ask for, and give them the absolute MINIMUM of information. Don't try to "satisfy" them by saying more than you have to.

Raed messed it up for you, Hoder. You can thank Niki for that, since I'm pretty sure that's the reason he ended up in San Francisco. Raed has supported the insurgency in Iraq (on his blog), while he was IN Iraq, which makes him an enemy national. He had NO trouble getting into the US. I suspect the outcry from blog readers when they heard the infamous Raed had made his way into the US (letters to congressman and such) has alerted the Department of Homeland Security to the existance of bloggers.

Ah hell, I know from first hand experience what a hell getting into the US can be. Hoder, I do know that the Border Patrol guy was simply doing his job, and actually using his brain a bit in the process. The fact that you are a blogger on the net simply made you an easier person to spot.
That being said, in my case, I am an American, born here, blue eyed, (not blond haired), raised in MS (piss off to the folks who think we ALL are uneducated), who happened to marry someone from China. I understand your frustration with the border patrol, but for someone in my situation, trust me, I keep up with the laws regarding travel over the border. My wife still is not a US citizen (thought she is planning to be, but not by my forcing her, obviously, we "ain't" perfect here), but my daughter was born here. In my case, being sure that my wife, and our daughter are not separated is paramount. You were calm in your situation, and that is to be commended. In my case, I could not say that I would be calm. I would probably have been arrested (felony charge at least, hey, break up my family, don't expect me to be kind. Classic american, right?).
I will be the first to say that our control of our borders needs to be better. Our system of determining who should be here and is no threat vs. someone who shouldn't be here and is a threat is laughable. 9/11 is a perfect example, and honestly, after traveling for a while, I don't see how it has improved.
But, a sloppy system is at least better than no system at all.
Please believe me when I say that the real (okay, not average) american really has no problem with someone from a foreign country coming to visit, or even set down roots here. This country is truely comprised of foreigners (unless you are an American Indian). The real problem is how to tell the people who are coming here for honest reasons from the people who are coming here to kill. I don't care if you are coming here and make us take a closer look at ourselves, just don't take any lives along the way, and be damned sure your message isn't "Kill, Kill, Kill" either (thanks to Arlo Guthrie). Intolerance is the one thing that shouldn't be tolerated (and hell yes, that means YOU, YOU fundie buggers).
So no, I am not the current version of a republican, since I don't find Bush's view of religion and how it relates to American reality in politics the least attractive. And no, I am not a democrat, since classically that party has no fiscal responsibility. I believe that the national government of a country is responsible to govern that country in the interest of ALL it's citizens. In the current highly partisan atmosphere, I am afraid that idea has been lost. I am however, a somewhat cosmopolitan person, who thinks that we, as a country, really need to take a look at ourselves. This country's growth, and prosperity, was actually brought about by the fact of a large immigrant influx. It would be a shame to take away our potential future prosperity as a country based on current fears.

This is outrageous and shouldn't be allowed. Border agents shouldn't be permitted to reach pass/fail conclusions on people based on data they can scan through real-time, simple Internet searches. Anything could come up. Data leading to people being denied entry to the US should come from studied, official investigative sources and methods (or, of course, immediately observable problems like the discovery of weapons or drugs or something). There is a ton of faulty information on the Internet that could lead to incorrect conclusions, and border agents are usually not experienced investigators. Even if you could prove the information is faulty, what recourse do you have when you return to Canada? It would take longer to sort it all out than it would take just to wait the six months until your next allowable visit. The danger of false Internet information is illustrated at the link here.

Patrick - you are truly an idiot. Did you even soak in the fact that this man is a Canadian citizen? Do you feel that Canadians are foreign nationals that should be heavily scrutinized? It may have caused temporary issues, but when it was all said and done he would have the truth on his side. Nevertheless, if he is correct in his statement that Candian citizens are able to visit the US for up to six months without special paperwork, he did nothing wrong and shouldn't have been detained or denied entry to the country. We are all well aware of the prices of freedom and any American worth his salt appreciates and respects those prices. Would "Switzerland" be the "land of the free" for you? As it is in the centre of Europe, it's a perfect observation point too. There are English-speaking communities here, too. I know many Canadians (granted: French-speaking Canadians) who live and work here.

I was detained entering Canada on my motorcycle and had to endure a search. The reason, I had crosed the border twice on my bike and once riding behind on my husbands bike in the same day. Act suspicious in any way and you will raise cautious heads. I was actually investigating reports that Canadian Border guards had been discriminating against motorcyclists.As a moto journalist, I discovered they were not discriminating, just doing thier jobs. I suspect the same is true in your instance except for your noteriety as a blogger no one would have even noticed. Oh and freedom isn't free, it comes at great cost and in Americia it is for American citizens. As a Canadian visitor you are a guest, the same as I am when I travel to Canada. Be well

With regards to what happened at the border, I know what your a going thru as I am a German living in NYC (completely legal as Bus drivers usually do stop on their way :-). Obviously you are a pretty smart guy, almost as smart as the Homeland Security guy. He did the better job then, you should outsmart him next time, though! A subscription label is really dumb, however, who would have expected those guys go as far as this one did? I really hope you make it back to NYC. Berlin would be a great choice, too (and easy to get to, just buy a visa somewhere in East Europe, well if you needed one) but never let other people determine where to live. Sorry about your experience, but as a US citizen, when traveling on business to Canada, I am almost always re-routed to another line for "further questions" along with snide comments like "oh we Canadians are so dumb we need a consultant from the US?", etc.

Having the Time magazine subscription is very suspicious, in that it takes at least a month just to start receiving the magazine, and if Time of all publications is so important to you, you can buy it at any corner newsstand - literally 1,000's of places in NYC - why would you go to the trouble to subscribe if your stay was going to be less than six months.
It seems that a more likely explanation is that you actually do live in NYC and have been doing this for a number of years while maintaining another address in Canada, your "legal" address, and you were on a milk run to pick up all your old Canadian mail, that why so much of it was in your possession on the way back.
Certainly, you were not breaking a major law, but just being a Canadian citizen does not automatically make you into a US Citizen.
What this shows is that Homeland Security may actually be a agency that is working, in the past anyone with the initative of this Border Patrol guy would have been fired.
Oh, and you admit it, your "Homeless" status, now that you are back in the North Country, means you were actually living in NYC, ie. your home was/is NYC, not because it's "sexier" but because this is were the money is.
Let this be a warning to all Canadian infiltrators!

I remember a Japanese Exchange student who was blacklisted from the U.S. for 5 years. Her next holiday, she tried to go to Vancouver, but her flight route had a connection in Los Angeles. They busted her at the airport, and made her fly back to Japan, rather than let her continue to Vancouver. And that was before 9/11
If you'd been a lawyer, you would have known to apply for the B-1 vistor visa, and wouldn't have found yourself of the position of trying to bullshit your way past security. As a Canadian citizen legally residing in the US, I applaud the border guards for doing their jobs. No offence meant, but there's a process to go through if you want to live in the US, and you obviously have used that process.
It's surprising you would have expected the guards to allow you through. You should know better.

If you're definition of freedom includesnot holding lawbreakers responsible for their actions, then come clean and say that. How do you think dangerous illegal immigrants get into the country, by parachute? They just set up a fake identity that will most likely allow them entry. The last time I came through the border my Wait was 2 hrs and the gaurds definately had a lot of fun making me sweat. I am in the states legally, I was applying for a VISA. They were not going to issue me one based on the fact that the company I work for refers to new, unproven, employees as "Interns" The bastard actually walked away saying he'd be back and sat eating lunch. Yeah, we haven't been the land of the free for quite some time now. I believe in opening the boarder to allow all peaceful people to enter to live, work or visit as they choose, but as the law stands now, overstaying your visa is illegal. If everyone obeyed the law, the economy here would collapse (no mexican farm workers). Of course to make the open boarder thing work, we'll also need to eliminate the welfare programs, minimum wage laws and the like. Socialism isn't compatible with individual freedom.

Aw, heck! I read a story of a Brit who overstayed his visa and in the ensuing 10 years set up businesses in San Diego and Los Angeles. There is a checkpoint on the highway in between those two cities. He got picked at random and asked a simple question: Where were you born? He told the truth (London), probably because he'd been in the US so long he forgot to be careful. Wham! Back to the UK. Another object lesson for immigration lawyers.
The US is a relatively free society, but it's not lawless. But, no hard feelings. Get your ducks in a row and come back if you want to.

This is one of those "the morons ruined it for the whole class" situations. Pre 9/11, you likely wouldn't have been asked any questions at all. Post 9/11, there's a lot more security being applied. Not always well, and certainly not uniformly (the porous Mexican border comes to mind), but you get the idea.
Just like a school situation where a few bad apples can spoil an outing, the 9/11 hijackers made the border less pleasant.
There's nothing unusual about that, btw. Go read up on pre and post WWI Europe. Before August 1914, the borders - across the entire continent - were wide open. It wasn't until the EU got to its present state that anything resembling that level of openness returned.

Reading the comments to your post, I'm starting to wonder who I dislike more: the border guard being overzealous or all these self-righteous commentators thinking it was a good thing you were refused entry. I think we should all be allowed to be in the place we choose, although I understand that might not always be feasible in our modern world. Yet, I don't think permission to live in NYC or any place else should be merrit-based or dependent on your political views. People suggesting differently claim ownership over a country that's not theirs. It's everyone's.

I understand your sadness about this but not knowing any more about your situation (if you could post more about your status of US citizenship that would be great) I am assuming that you aren't a citizen and your visa has expired. I understand that its difficult to get a legal way into the country but at the same time the border guard was doing his job not harrasing you. I would, if I were you, look into legal action about the way he did it but in the end it seems like he was right so you might not get anywhere with it but it is kind of intrusive I guess what he did so you might have a chance. In closing though like I tell everyone else THAT IS THE RISK YOU TAKE WHEN YOU PUT SHIT ONLINE!!!

What? When, if ever, was it possible for someone, not a legal resident of the U.S., to cross our borders at will? Except for U.S. citizens, no one has an absolute right to enter the U.S. While I respect your admiration for (some parts) of our country, it seems you knew you were doing something that wan't completely within the rules. I hope that you will find a way to return, legally, and that when you do, you recognize that your visits here are a privilege that you get in exchange for your agreement to conform with immigration requirements.
As far as the poster who decried the demise of the Fourth Amendment, I'd recommend doing little reading on what the Fourth Amendment actually says, and then do a little reading on the power of sovereign nations to control their borders. You might be surprised at what you find.

A Japanese TV producer friend once took a gambling/leave-the-country trip to the Bahamas and walked off with all the Americans instead of checking in with Immigration. On the way back, since he didn't have an exit stamp, US Immigration stamped "NO RETURN FOR TEN YEARS" in his passport right on the spot. No questions asked.
Have you thought of France, though? When I tried to register a car with only my tourist visa and an affidavit from my friend whose address I was using, the official helpfully suggested I rewrite it. It had said "he's been living here nine months," which would have meant I was an illegal. She suggested "he uses this address during his regular stays in France."
Of course, she also let me jump in line in front of the entire waiting room of browner foreigners. Guess they haven't quite gotten that egalite' thing worked out yet.

Anyway, you as a Canadian resident may still have the possibility to go to NY. But let me complain that I, as a reseasrch fellow of the John Kluge Center at the US Library of Congress and while being invited by a US government organ, just because of participation in a conference in Iran since the last May I am living in Germany waiting for my Visa! Nobody answers to my concerns, and no comment why I can not get my Visa.
I faced many problems in both my work and personal life because of the delay in Visa. Now I gave up my fellowship and won’t get back to US but I am sure such a huge and chaotic administration in USA with regard to Visa questions has already failed. They enormously harm the US academic relation. I hope American insightful academicians would understand this big damage to US scientific reputation and can find a solution for that. Don't worry, under again read the Hafez and look forward to living in Europa, closer to homeland and with a more humane environment for us as social activists!

I've sat in the immigration office in Toronto several times myself travaling from the US on business.
hassled because I didn't have the proper documentation to show that I wasn't going to work in canada while I was there. I've been flagged so I have to show documentation every time I go there to state what I'm doing there from the canadian company (which is a branch of our US company). So now I get a letter from the canadian branch everytime I go.
They told me that I'd be denied entery any time after that when I didn't have the letter, so I do it there way . no problem now that I play by there rules.
So know the laws and follow them and don;t complain.
